This notice applies to all users of CleanWater.ke's services in Kenya, including our applications, websites, features, or other services. This notice describes how CleanWater.ke and its affiliates collect and use personal data. This notice applies to all CleanWater.ke users, including:

  • Customers: individuals who request or receive water delivery services.
  • Vendors: business owners who manage fleets of drivers and trucks.
  • Drivers: individuals who operate water bowsers on behalf of Vendors.

II. Data Controller

CleanWater.ke is the data controller for the personal data collected in connection with the use of our services in Kenya. We are responsible for ensuring that your data is handled in accordance with this notice and applicable data protection laws.

III. Data Collection and Uses

A. The data we collect

CleanWater.ke collects personal data:

  • Provided by users to CleanWater.ke, such as during account creation (name, email, phone number, address). For Vendors, this also includes business details, equipment specifications, and uploaded compliance documents. For Drivers, this includes name and contact information provided by their Vendor owner.
  • Created during use of our services, such as precise or approximate location for both Customers (for delivery) and Drivers (for dispatch), transaction details, order history, user ratings, and device data.
  • From other sources, such as Vendors providing information about their Drivers, or users providing feedback (e.g., ratings and comments).

B. How we use personal data

We use the data we collect to:

  • Provide our services: This includes using data to create and manage user accounts, enable deliveries, and facilitate payments. Location data is critical for our AI-powered Smart Order Dispatch system, which uses H3 geospatial indexing to find the most suitable nearby Driver.
  • Safety and security: We use personal data to help maintain the safety, security, and integrity of our services and users. This includes using vendor compliance documents for our AI-powered audit system and analyzing user ratings to manage vendor reputation.
  • Customer support: We use information we collect (including order history and chat messages) to provide customer support and to investigate and address user concerns.
  • Research and development: We may use anonymized and aggregated data for analysis, machine learning, and product development to improve our services, including our AI-powered features like Smart Order Dispatch and Demand Forecasting.
  • Enable communications between users: For example, a Customer may contact their assigned Driver through the app to coordinate a delivery.
  • Legal proceedings and requirements: We may use the personal data we collect to investigate or address claims or disputes relating to use of CleanWater.ke's services.

IV. Data Sharing and Disclosure

Some of CleanWater.ke's services and features require that we share personal data with other users or at a user’s request. For example, we share a Customer's first name and delivery location with their assigned Driver/Vendor to facilitate a delivery. We may also share data with our affiliates, subsidiaries, and partners for legal reasons or in connection with claims or disputes. We do not sell your personal data to third parties.

V. Data Retention and Deletion

CleanWater.ke retains personal data for as long as necessary for the purposes described above. This means that we retain different categories of data for different periods of time depending on the category of user, the type of data, and the purposes for which we collected it.

Users may request deletion of their accounts at any time through their profile page. CleanWater.ke may retain personal data after a deletion request due to legal or regulatory requirements, for purposes of safety, security, and fraud prevention, or because of an issue relating to the user's account such as an outstanding credit or an unresolved claim or dispute.

VI. Your Rights and Choices

CleanWater.ke enables users to access and control the data that we collect, including through their in-app profile settings and by allowing users to request access to or correction of their data.

VII. Updates to this Notice

We may occasionally update this notice. If we make significant changes, we will notify users in advance of the changes through the CleanWater.ke apps or through other means, such as email. We encourage users to periodically review this notice for the latest information on our privacy practices.
